Is BHFC Financial Services in Glendale operating an illegal business?

BHFC Financial services is a privately owned auto finance company in Glendale, Arizona. They finance subprime customers at astronomical interest rates. Read the contract before you sign because you’re going to pay 29% interest regardless of your credit situation. Not only are you going to pay 29% interest every year you’re going to pay double for the car itself. BHFC advises their dealerships to sell vehicles at 200% of market value. Before you purchase a vehicle with BHFC as the finance company see what the true value of the car you’re buying is worth.

When a financial institution repossesses a vehicle they auction off your vehicle and notify you of sale including time, date and location. The reason behind this is if there is a deficiency or overage you will either gain or owe money as a consumer. What does BHFC do? They resell your vehicle to another consumer through dealerships they partner with. They simply place your vehicle right from the repossession truck onto these partner dealerships and wait for a new customer.

According to Arizona law the resale of repossessions must be done in a commercially reasonable manner. How can they possibly do this when they dictate the price of reselling your vehicle as the partner dealership is reselling your vehicle? How will you possibly get written notice of time date and location of the vehicle being sold as required by Arizona law if they don’t know themselves?

Chances are if you financed a car through BHFC Financial Services you probably had your vehicle repossessed and resold over and over again regardless if you owed one payment or 40. BHFC illegally has GPS units installed into their vehicles without notifying its customers so they can track your location for repossession at any given time. According to Arizona law a GPS tracking disclosure must be signed however BHFC would rather hide the fact that they can track your location at any given time.

So why are banks like PNC Bank extending lines of credit to companies like this? Why is BHFC allowed to bend the law? Is the mayor of Glendale Jerry Weiers related to co-owner James Weiers? Seems awfully suspect that Jerry Weiers is the mayor to pass the law in Arizona allowing repossessions to be reported as stolen vehicles. If you think you’ve been illegally repossessed by BHFC Financial Services please read Arizona laws regarding repossession and contact the Arizona Attorney General.
